EB-1(b) Outstanding Professors and Researchers Visa

 

The EB-1(b) visa is an immigrant visa for professors and researchers who are internationally recognized in their particular scientific or scholarly fields. While this visa type does not require a labor certification, it does require a permanent job offer from a U.S. employer.  The U.S. employer must also apply for the visa on behalf of the alien (meaning that the employer is the “petitioner”and the alien is the “beneficiary” of the application).  In order to obtain an EB-1(b) visa, the petitioner must show that the alien meets at least two of the following criteria:

 

1.  Alien has received major prizes or awards for outstanding achievement.

2.  Alien in associations that require their members to demonstrate outstanding achievement.

3. Material written by others about the alien’s work in the academic field has been published in professional publications.

4.  Alien has participated, either on a panel or individually, as a judge of the work of others in the same or allied academic field.

5.  Alien has made original scientific or scholarly research contributions in the field.

6.  Alien has written scholarly books or articles (in scholarly journals with international circulation) in the field.
